SMSF Setup and 1st Annual Administration Application

There are two types of regulated Self Managed Superannuation Funds (SMSFs) Individual Trustees SMSF and Corporate Trustee SMSF.

Individual Trustees SMSF can be a single or multiple member fund. Individual trustees single member fund has only one member. The member is also the trustee of the fund, and the fund must have another individual as a trustee only. The second trustee cannot be a member of the fund. Second trustee can be a relative of the member, or alternatively, can be any other person providing the member is not an employee of that person. Individual trustees multiple member fund has more than one, and up to four members. Each trustee of the fund is also the member of the fund. Members of the fund cannot be employees of another member, unless they are related.

Corporate SMSF can be a single or multiple member fund. Corporate single member fund has only one member and a company as a trustee of the fund. The member of a corporate trustee single member fund must be the sole director of that company, or must be related to the other director of the trustee company and they have to be the only two directors of that company. Corporate multiple member fund has more than one, and up to four members, and a company as a trustee of the fund. Each director of the company is a member of the fund.

If you wish to setup a self managed superannuation fund with a Corporate Trustee, the Company needs to be incorporated first, and only after you obtain the ACN (Australian Company Number) you can continue establishing your fund. Please Note: Generally, an Australian resident who is 18 years of age and not under a legal disability can be a trustee of a SMSF. The person cannot be a fund trustee if he/she is an undischarged bankrupt, or convicted of dishonest conduct, or received a civil penalty order, or is a disqualified person by the regulator (ATO or APRA).
